§1 Scope and definitions

(1) These General Terms and Conditions apply to all deliveries between us and consumers in the version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business or self-employed professional activity (Section 13 German Civil Code).

§2 Formation of contract and storage of contract text

(1) The following rules on conclusion of contract apply to orders placed through our online shop https://www.trainvent.com/.

(3) The presentation of goods in our online shop does not constitute a legally binding offer on our part; it is merely a non-binding invitation to consumers to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.
(4) When an order is received in our online shop, the following rules apply: the consumer submits a binding contractual offer by successfully completing the order process provided in our online shop.

The order is placed in the following steps:

Before submitting the binding order, the consumer may use the Back button in their web browser to return to the page on which the data was entered and correct input errors, or cancel the order process by closing the browser. We confirm receipt of the order immediately by an automatically generated email (“order confirmation”). By doing so, we accept your offer.

(5) Storage of the contract text for orders placed through our online shop: We store the contract text and send you the order data and our Terms and Conditions by email. You can view the Terms and Conditions at any time at https://www.trainvent.com/agb.

§3 Prices, shipping costs, payment and due date

(1) The prices shown are final prices. No VAT is charged under the small-business exemption pursuant to Section 19 of the German VAT Act (UStG). Any applicable shipping costs are additional.

(2) Consumers may pay by PayPal and by the card and wallet payment methods displayed at checkout. The payment methods available in each case are shown at checkout.

§4 Delivery

(1) Unless otherwise stated in the product description, physical goods, including customised products, are dispatched no later than five working days after conclusion of the contract.

(2) Digital products are provided electronically immediately after successful payment.

(3) The risk of accidental loss and accidental deterioration of the goods sold passes to the buyer only upon handover of the goods, including in the case of shipment.

§5 Eigentumsvorbehalt

We retain ownership of the goods until the purchase price has been paid in full.

Consumers have a right of withdrawal under the following provisions. A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business or self-employed professional activity.

Cancellation policy

Right of withdrawal

You may cancel your purchase without giving a reason within 30 days after receiving the goods. If items from a single order are delivered separately, the period starts when you receive the last item. Sending your cancellation notice before the 30-day period expires is sufficient to meet the deadline. We voluntarily extend the cancellation period to 30 days; your statutory rights remain unaffected.

To exercise your right of withdrawal, you must inform us

by means of a clear statement (for example, a letter sent by post or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but this is not mandatory.

Consequences of withdrawal

If you withdraw from this contract, we must reimburse all payments we have received from you, including delivery costs (except for additional costs arising from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notice of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise; in no event will you be charged fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send off the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

Digital content

For paid digital content supplied without a physical medium (such as download files), your right of withdrawal ends early only if we have started performing the contract, you expressly consented to performance starting before the withdrawal period expires and acknowledged that you thereby lose your right of withdrawal when performance begins, and we have provided you with confirmation of the contract on a durable medium (such as email) recording your consent and acknowledgment. If these conditions are not met, your right of withdrawal remains. Your statutory rights concerning defective digital content remain unaffected.

§9 Contract language

The contract language is German. An English translation of these General Terms and Conditions is provided solely to make them easier to understand. In the event of any discrepancy between the German and English versions, the German version shall prevail.
